These Terms of Use govern your access to and use of the website of the Law Office of Brandon Martin. By using this site, you agree to them. If you do not agree, please do not use the site.

No legal advice

Everything on this site — the practice pages, blog posts, videos, checklists and answers to common questions — is general information about California estate planning and probate. It is not legal advice, and it is not a substitute for advice from a lawyer who knows your particular circumstances. Estate planning and probate outcomes turn on facts and on law that changes; do not act, or decline to act, based on anything you read here without speaking to an attorney.

No attorney-client relationship

Using this site, submitting the contact form, booking a consultation, or sending an email does not create an attorney-client relationship. No such relationship exists until we have run a conflicts check, agreed to represent you, and both signed a written engagement agreement. Until then, please do not send us confidential or time-sensitive information.

Deadlines are your responsibility until we are engaged

Probate and other legal matters are subject to strict time limits. Because contacting us does not make us your lawyers, we assume no responsibility for any deadline unless and until we have been formally engaged. If a deadline may be near, say so when you call.

Advertising notice

This website may be considered attorney advertising under the California Rules of Professional Conduct. Past results do not guarantee, warrant, or predict future outcomes, and no result in any particular matter is promised. Any testimonial or endorsement that appears on this site is not a guarantee of a similar outcome.

Jurisdiction

Brandon Martin is licensed to practice law in the State of California only. Nothing on this site is an offer to practice law in, or to provide advice concerning the law of, any other jurisdiction. The site is directed to residents of California and, in particular, Kern County.

Fees and scheduling

The initial ten-minute telephone consultation is offered at no charge and exists solely to determine whether the representation is a good fit for both of us. It is not a legal opinion. In-person and extended meetings are billed. Any flat fee quoted on this site or in conversation, and any estimate of the statutory fees payable in a probate matter, is an estimate only until it is set out in a signed engagement agreement, which controls.

SMS and text message communications

By providing your mobile phone number to the firm and using our services, you agree to the following terms regarding SMS text message communications:

1. The Law Office of Brandon Martin uses SMS text messaging to communicate with clients regarding their legal matters, including appointment reminders, case updates, deadline notifications, and other communications directly related to our attorney-client relationship.
2. You can cancel the SMS service at any time. Just text STOP to opt out. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at (661) 489-0000 or by emailing the firm at brandon@brandonmartinlaw.com.
4. Carriers are not liable for delayed or undelivered messages.
5. Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the Text Message services.
6. Message frequency varies.
7. Message and data rates may apply.
8. Consent to receive SMS messages is not a condition of representation.
9. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Acceptable use

You agree not to use this site unlawfully; not to attempt to gain unauthorized access to it or to any related system; not to introduce malicious code; not to scrape, harvest, or copy its content for commercial purposes; and not to use the contact form to send unsolicited commercial messages.

Intellectual property

The content of this site, including text, video, images, and the firm’s name and logo, is owned by the Law Office of Brandon Martin or used with permission, and is protected by copyright and trademark law. You may read, print, and share pages for your own personal, non-commercial use. Any other reproduction or distribution requires written permission.

This site links to court websites, official forms, scheduling tools and video platforms as a convenience. We do not control those sites, are not responsible for their content or availability, and linking to them is not an endorsement.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of them shall be brought exclusively in the state or federal courts located in Kern County, California.

We may revise these Terms at any time. The version posted here, bearing the date above, is the one that applies. If any provision is held unenforceable, the remaining provisions stay in effect.
